These Terms of Sale govern the purchase of a used motor vehicle from Clarks Garage and Car Sales (“the Seller”, “we”, “us”) by the customer (“the Buyer”, “you”). By signing or completing the purchase, you confirm acceptance of these terms.

1.1. All vehicles are used and sold subject to age, mileage, and normal wear and tear.
1.2. Vehicle details, including mileage, specification, and condition, are provided in good faith and reflect information available at the time of sale.
1.3. Mileage readings are recorded as displayed and are not guaranteed unless expressly stated in writing.
1.4. The Buyer confirms they have been given the opportunity to inspect the vehicle and are satisfied with its condition at the point of sale.
1.5. Clarks Garage and Car Sales does not warrant that the vehicle has not been subject to previous repairs, accident damage, or component replacement unless explicitly stated.

2.1. The vehicle price is as agreed and shown on the sales invoice.
2.2. Full cleared payment must be received before vehicle release.
2.3. Deposits secure the vehicle and are non-refundable unless otherwise agreed in writing.
2.4. Vehicles remain the property of Clarks Garage and Car Sales until full payment has cleared.

Where applicable, vehicles are supplied with a 6 month 3rd party warranty covering sudden mechanical failure of major components only.

The warranty does not cover:

• Wear and tear items (including but not limited to brakes, clutches, tyres, suspension, batteries, bulbs, filters)
   
• Service items or routine maintenance
   
• Faults arising from misuse, neglect, overheating, or continued driving after a warning light or fault occurs
   

The warranty will be immediately void if:

• Any inspection, diagnostic work, repair, or servicing is carried out by a third party without prior written approval from Clarks Garage and Car Sales
   
• Non-approved, aftermarket, or second-hand parts are fitted
   
• The vehicle is remapped, modified, tuned, or altered in any way
   

No unauthorised repair costs will be reimbursed under any circumstances.

• All warranty claims must be reported to Clarks Garage and Car Sales before any work is undertaken
   
• The vehicle must be returned to Clarks Garage and Car Sales’ premises for inspection and any authorised warranty repairs
   
• All recovery, transportation, and delivery costs are the sole responsibility of the Buyer, regardless of the nature of the fault
   
• Warranty repairs will only be carried out after inspection and confirmation of eligibility
   

4.1. Vehicles sold as “TRADE SALE”, “SPARES OR REPAIRS”, or “SOLD AS SEEN” are sold without warranty, guarantees, or aftersales obligations.
4.2. These vehicles are not sold as roadworthy unless explicitly stated in writing.
4.3. The Buyer confirms they are purchasing in a trade or business capacity, or with full knowledge that statutory consumer protections do not apply.
4.4. No refunds, repairs, or returns will be offered for trade sale vehicles.

(Trade sale status will be clearly stated on the invoice and acknowledged by the Buyer.)

5.1. Nothing in these Terms affects the Buyer’s statutory rights under the Consumer Rights Act 2015.
5.2. The Buyer has the right to reject the vehicle within 30 days if a serious fault was present at the time of sale and not disclosed.
5.3. After 30 days and within six months, Clarks Garage and Car Sales is entitled to one opportunity to repair or replace the vehicle.
5.4. No refund will be given for wear and tear, minor defects, or faults arising after sale.

6.1. Vehicles are supplied with a valid MOT where legally required.
6.2. Any MOT advisories are the Buyer’s responsibility.
6.3. The Buyer is responsible for ensuring the vehicle is insured, taxed, and roadworthy after collection.

7.1. Clarks Garage and Car Sales warrants that vehicles are owned by us and free from finance unless disclosed.
7.2. The V5C will be transferred to the Buyer. Responsibility for DVLA notification rests with the Buyer.

8.1. Clarks Garage and Car Sales accepts no liability for:

• Breakdown or failure after collection
   
• Recovery or transportation costs
   
• Loss of earnings or inconvenience
   
• Third-party repair or inspection charges
   

9.1. Complaints must be submitted in writing to Clarks Garage and Car Sales at

9.2. We aim to resolve complaints within 14 working days.
9.3. If unresolved, disputes may be referred to the Motor Ombudsman, Trading Standards, or the County Court.

These Terms are governed by the laws of England and Wales.
